SUBJECT: NUCLEAR EXPLOSIVE AND WEAPON SAFETY PROGRAM
1. PURPOSE. This is a Supplemental Directive to the DOE Order 5610.10,
NUCLEAR EXPLOSIVE AND WEAPON SAFETY PROGRAM, dated 10-10-90. This
Supplemental Directive assigns the Department of Energy (DOE)
Albuquerque Field Office (AL) requirements and responsibilities for its
Nuclear Explosive and Weapon Safety Program as defined in DOE Order
5610.10. Where necessary, amplification of DOE Order 5610.10
requirements is provided. This Supplemental Directive does not change
any requirements contained in the DOE Order, but contains
administrative or contractual guidance.
2. CANCELLATIONS. Pages 1-4 of AL Supplemental Directive 5610.10, PROGRAM
TO PREVENT ACCIDENTAL OR UNAUTHORIZED NUCLEAR EXPLOSIVE DETONATIONS,
dated 10-2-92, are superseded.
3. SCOPE. This Supplemental Directive applies to AL organizations and its
contractors and subcontractors that conduct nuclear explosive and
nuclear weapon system safety, production operations, security, and
control activities in support of the nuclear weapons program as
provided by law and/or contract and as implemented by the appropriate
contracting officer. References may be made to other than AL
organizations due to requirements in the DOE 5610 series orders
concerning Nuclear Explosive and Weapon Safety.
4. APPLICABILITY. This Supplemental Directive applies to all activities
and operations involving nuclear explosives and nuclear weapons
conducted by AL under the Department's nuclear weapon program.
5. REFERENCES. Authority is based on the following:
a. Atomic Energy Act of 1954, as amended.
b. The DOE Order 5610.10, NUCLEAR EXPLOSIVE AND WEAPON SAFETY
PROGRAM, of 10-10-90, which establishes DOE policy, objectives,
and responsibilities for the DOE Nuclear Explosive and Weapon
Safety Program.
c. The DOE Order 5610.11, NUCLEAR EXPLOSIVE SAFETY, of 10-10-90,
which establishes the DOE policy for the protection of public
health and safety in maintaining a formal, comprehensive, and
systematic Nuclear Explosive and Weapon Safety Program.
d. The DOE Order 5610.1, PACKAGING AND TRANSPORTING OF NUCLEAR
EXPLOSIVES, NUCLEAR COMPONENTS, AND SPECIAL ASSEMBLIES, of
9-11-79, which establishes DOE policy and assigns responsibilities
and authorities for the packaging and transporting of nuclear
explosives, nuclear components, and special assemblies.
e. The AL Supplemental Directive 5610.11, Nuclear Explosive Safety,
dated 8-9-91.
f. The DOE Order 5610.13, JOINT DEPARTMENT OF ENERGY/DEPARTMENT OF
DEFENSE NUCLEAR WEAPON SYSTEM SAFETY, SECURITY, AND CONTROL
ACTIVITIES, 10-10-90, which establishes DOE policy, procedures,
authorities, and responsibilities for addressing joint nuclear
weapon and nuclear weapon system activities in conjunction with
the Department of Defense (DOD).
g. The AL Order 5610.13, Joint DOE/DOD Nuclear Weapon System Safety,
Security, and Control Activities, dated 9-23-91.
h. The AL Order 56XC, AL NUCLEAR WEAPONS STOCKPILE EVALUATION
PROGRAM, of 6-1-90, which sets forth principles and policies for
AL Nuclear Weapons Stockpile Evaluation Programs (SEP).
i. The DOE Order 5400.5, RADIATION PROTECTION OF PUBLIC AND THE
ENVIRONMENT, Change 1, of 6-5-90, which establishes requirements
to protect members of the public and the environment against undue
risk from radiation while conducting DOE operations.
j. The DOE Order 5480.1B, ENVIRONMENT, SAFETY, AND HEALTH PROGRAM FOR
DEPARTMENT OF ENERGY OPERATIONS, of 9-23-85, which establishes the
Environment, Safety, and Health (ES&H) Program for DOE and DOE
contractors.
k. The DOE Order 5480.5, SAFETY OF NUCLEAR FACILITIES, 9-23-86, which
establishes a nuclear facility safety program for DOE.
l. The DOE Order 5480.7, FIRE PROTECTION, of 11-16-87, which
establishes requirements for improved risk level of fire
protection.
m. The DOE Order 5480.10, CONTRACTOR INDUSTRIAL HYGIENE PROGRAM, of
6-26-85, which establishes requirements and guidelines for DOE
contractor operations for an effective industrial hygiene program
to preserve employee health and well-being.
n. The DOE Order 5480.11, RADIATION PROTECTION FOR OCCUPATIONAL
WORKERS, of 7-20-89, which establishes radiation protection
standards and program requirements for DOE and DOE contractor
operations.
o. The DOE Order 5480.16, FIREARMS SAFETY, of 10-10-90, which
provides procedures for the safe use of firearms used in a manner
to ensure safety and health of DOE and contractor personnel, as
well as the public, and consistent with operational objectives.
p. The DOE Order 5480.19, CONDUCT OF OPERATIONS REQUIREMENTS FOR DOE
FACILITIES, of 7-9-90, which provides guidelines for the conduct
of operations at DOE facilities and establishes policy to assure
an acceptable level of safety in conduct of their operations.
q. The DOE Order 5481.1B, SAFETY ANALYSIS AND REVIEW SYSTEM, of
9-23-86, which establishes uniform requirements for preparation
and review of safety analysis of DOE operations, identification of
hazards, their elimination and control, assessment of risk, and
documented management authorization of operations.
r. The DOE Order 5483.1A, OCCUPATIONAL SAFETY AND HEALTH PROGRAM FOR
DOE CONTRACTOR EMPLOYEES AT GOVERNMENT-OWNED CONTRACTOR-OPERATED
FACILITIES, of 6-23-83, which establishes occupational safety and
health standards pursuant to the Atomic Energy Act of 1954, as
amended, the Energy Reorganization Act of 1974, DOE Organization
Act of 1977, Occupational Safety and Health Act of 1970, and
Public Law 91-596.
6. DEFINITIONS.
a. Independent Assessment/Evaluation--Oversight/analysis by persons
or entities that are free from conflict of interest; for example,
having no previous authorities or responsibilities for any aspect
of the process under assessment or evaluation.
b. Line Management--A DOE or DOE contractor-employed individual, or
group of individuals, having direct line responsibility,
authority, and accountability for conducting a program or group of
programs.
c. Program Managers--DOE or contractor-employed personnel who are
directly involved with, and responsible for, the oversight of a
program or group of programs.
d. Qualified Expert--One who by professional training, having
acquired special knowledge in a particular subject, through
demonstrated skills, and documented practical experience has
developed a thorough mastery of the theories, methods,
applications, practices, and experimental and operational data
available and not just a general knowledge of a particular
subject; and who currently is or recently has had extensive
practice in the particular subject.
e. Resources--Personnel, capital equipment, and fiscal support
committed by management for the attainment of program goals.
7. RESPONSIBILITIES AND AUTHORITIES. Within the DOE, safety is a line
management responsibility. The following authorities and
responsibilities apply to the AL Nuclear Explosive and Weapon Safety
Program:
a. Manager, AL, in addition to the responsibilities and authorities
in paragraph 7.b below, is responsible to DP-20 for:
(1) Assuring that all operational aspects of this Nuclear
Explosive and Weapon Safety Program for onsite and offsite
transportation activities, except those onsite activities at
the Nevada Test Site that are the responsibility of the
Manager, DOE Field Office, Nevada, and the onsite activities
at the Lawrence Livermore National Laboratory that are the
responsibility of the Manager, DOE Field Office, San
Francisco, are conducted in accordance with DOE Order 5610.11
and DOE Order 5610.1.
(2) Assuring that nuclear explosive safety policy, requirements,
and standards as promulgated by the Secretary of Energy are
implemented.
(3) Assuring that resources are provided for the Nuclear Safety
Program elements of DOE Order 5610.10.
(4) Administering, for DP-20, DOE's program for participation in
DOD Safety Studies and Reviews of the Nuclear Weapon System
Safety Program, and assisting in safety rules processing in
accordance with DOE Order 5610.13.
(5) Approving Nuclear Explosive Safety Survey Reports.
(6) Assuring that overall program management and direction
including implementing safety policy, promulgating safety
directives, and interfacing with the DOD's Nuclear Weapon
System Safety Program are in compliance with requirements
established for the Nuclear Explosive and Weapon Safety
Program in this and related Orders and Instructions.
b. The AL Area Offices assist AL in the implementation of this
program and are responsible to AL for implementing the provisions
of this and related safety Orders and Instructions in their areas
of authority and responsibility. This includes:
(1) Assuring that Area Offices, laboratory, contractor, and
subcontractor line managers have been assigned safety program
responsibilities.
(2) Assuring that the mandate to comply with DOE health, safety,
and environmental requirements, rules, standards, and
criteria is fully considered in the planning of all nuclear
explosive and nuclear weapon operations.
(3) Assuring that management and staff of their safety
organizations have full access and free communications with
the Area Office Manager and/or the Manager, AL, on nuclear
explosive and nuclear weapons safety matters.
(4) Assuring that prior to beginning any operation involving a
nuclear explosive or transportation of a nuclear explosive
that either a Nuclear Explosive Safety Study or Nuclear
Explosive Safety Survey is conducted by the AL, Nuclear
Explosive Safety Division (NESD), and approved by the
Manager, AL, and DP-20.
(5) Developing and publishing such orders or guidelines as are
necessary to implement DOE 5610.10 and related Orders.
(6) Assuring that appropriate safety awareness and training
programs are developed, documented, and implemented to ensure
the safe conduct of activities covered by this Supplemental
Directive.
c. Assistant Manager, AL, Office of Operations and Weapons reports to
the Manager, AL, and is responsible for:
(1) Assuring that there is an active, continuous review of the
design and development of each new weapon system and the
stockpile to identify safety and use-control feature concerns
and that there is a program to provide for stockpile
improvements and development of positive measures to address
identified concerns.
(2) Conducting a periodic review and, if required, participate in
revising the Supplemental Directives to the AL 5610 series
Instructions.
(3) Assuring that appropriate recommendations are appended to
requests for any deviations or exclusions from safety
requirements, standards, and criteria established by the
Nuclear Explosive and Weapon Safety Program in this Order and
related Orders, laws, or regulations and are promptly
submitted to the Manager, AL, and DP-20. Exclusions and
deviations will be consistent with legal or regulatory
provisions for obtaining them.
(4) Assuring that AL-identified safety issues are addressed and
resolved in a timely manner. Unresolved safety issues will
be elevated to the appropriate management level.
(5) Assuring that new nuclear weapon designs incorporate current
safety features, as directed by DP-20, unless there are
overriding reasons for not incorporating them, and explicitly
documented agreements are reached between the Secretaries of
Energy and Defense. (See DOE Order 5610.10, paragraph 12.)
(6) Assuring that there is a safety review process in place under
which all operations are documented for identification of
risks. These risks are analyzed and documented in safety
analyses and risk assessments so that informed management
decisions can be made regarding conduct of the operation.
Any additional positive measures to reduce risk to acceptable
levels will be reviewed by an appropriate independent staff
not responsible for the conduct of the operation.
(7) Assuring that operational Safety Analysis Reports are
developed, reviewed, and in compliance with public laws
relating to environmental protection, radiation safety,
worker safety, and DOE policies for environment, safety, and
health before any Nuclear Explosive or Nuclear Weapon
Programs are conducted at DOE facilities.
(8) Specifically for the Stockpile Evaluation Program, in
conjunction with the DOD, develop and maintain a Non-nuclear
Assurance Program to assure that evaluation units provided to
the DOD for field or flight testing do not contain materials
capable of producing a nuclear yield.
d. Assistant Manager, AL, Office of Safeguards and Security (OSS)
reports to the Manager, AL, and is responsible for:
(1) Assuring that planned and implemented safeguards and
security policies and standards are consistent with safety
requirements.
(2) Forwarding requests for any deviations or exclusions from
safety requirements, standards, and criteria established by
the Nuclear Explosive and Weapon Safety Program in this and
other Supplemental Directives, related Orders, laws, or
regulations to the Manager, AL, and DP-20, if appropriate.
Exclusions and deviations will be consistent with legal or
regulatory provisions for obtaining them.
(3) Assuring reviews of personnel security files for Personnel
Assurance Program (PAP) certification in DOE Order 5610.11.
(4) Director, Transportation Safeguards Division reports to the
Assistant Manager, OSS, and is responsible for:
(a) Assuring that Transportation Safety Analysis Reports are
developed, reviewed, approved, and complied with to
assure DOE policies for ES&H are in compliance with
public laws relating to environmental protection,
radiation, safety, and worker safety before any nuclear
explosive or nuclear weapon is transported off DOE
sites.
(b) Certified Personnel/PAP. Maintaining the PAP for the
certified personnel responsible for transportation
activities of the Nuclear Explosive and Weapon Safety
Program, as outlined in DOE and AL 5610.11 Orders and
Supplemental Directives.
(c) Occurrence Reporting and Tracking System. Maintaining
an occurrence reporting and tracking system which
encompasses requirements of DOE 5000.3A and DOE 5200.2A
to ensure prompt notification and appropriate action of
DOE officials.
e. Director, Office of Emergency Plans and Operations reports to the
Manager, AL, and is responsible for providing support and
coordination for DOE 5610.10 with DOE 5500.10, paragraph 8., and
DUE 5500.1B, paragraph 9.c and 10.b as appropriate.
f. Assistant Manager, Office of Environment, Safety, and Health
(OESH) reports to the Manager, AL, and is responsible for;
(1) Assuring that prior to DP-20 approval and conduct of nuclear
explosive or nuclear weapon operation by DOE and DOE
contractors, a Nuclear Explosive Safety Study or Survey is
performed by qualified independent safety experts not
responsible for the design or conduct of operation. The
study/survey shall include consideration of risk estimates
for credible accidents and dispersal of toxic and/or
radioactive materials as defined by DOE 5610.10.
(2) Reviewing and providing decisions/recommendations on requests
for any deviations or exclusions from safety requirements,
standards, and criteria established by the Nuclear Explosive
and Weapon Safety Program in this Supplemental Directive and
related DOE Orders, laws, or regulations and forwarding to
DP-20, for approval. Exclusions and deviations will be
consistent with legal or regulatory provisions for obtaining
them.
(3) Assuring that identified safety issues are addressed and
resolved in a timely manner.
(4) Assuring that there is an oversight program to: 1) monitor
and continuously review the stockpile to identify safety
concerns, and 2) provide for the stockpile improvements or
positive measures to address identified safety and
use-control concerns.
(5) Assuring that all safety actions related to nuclear weapons
safety requiring a DOE concurrence with the DOD are
thoroughly analyzed from a safety viewpoint by qualified
independent safety experts, with special emphasis on the
DOE's joint safety responsibility as required by Presidential
Directive.
(6) Exercising responsibility for all ES&H and non-weapons
Quality Assurance (QA) matters related to the nuclear
explosives and nuclear safety program facilities or
activities under AL administrative or programmatic control.
(7) Assuring that planned and implemented safety policies and
standards are consistent with safeguards and security
requirements.
(8) Developing and maintaining nuclear explosive safety
directives, requirements, and standards for promulgation by
the AL Manager.
(9) Provide monthly activity reports to Headquarters (HQ) DOE,
DP-20, on progress and activities relative to this
Supplemental Directive.
(10) Evaluating reported occurrences to assure corrective actions
are taken.
(11) Director, Health Protection Division (HPD) is responsible to
the Assistant Manager, OESH, and assists the Manager, AL, in
implementation of the mandate to comply with DOE Radiation
Protection and Industrial Hygiene requirements, rules,
standards, and criteria in planning of all Nuclear Explosive
and Nuclear Weapon operations, and is responsible for:
(a) Functional Reviews and Appraisals. Radiation Protection
and Industrial Hygiene aspects of Albuquerque contractor
nuclear explosives and weapon safety programs will be
assessed as part of the HPD scheduled and performed
functional reviews and appraisals of contractor site
Radiation Protection, Industrial Hygiene, and
Occupational Medicine programs. These reviews and
appraisals will be used by the HPD to assess the Health
Protection aspects of the overall safety of contractor
Nuclear Explosive and Weapon Safety Program.
(b) Nuclear Weapons Safety Reviews. Supporting Weapon
Programs Division (WPD) or NESD in the performance of
Nuclear Explosive Safety reviews involving or
potentially involving Health Protection (Radiation
Protection or Industrial Hygiene) issues. The Director
of HPD will, in consultation with WPD or NESD (as
appropriate), determine the level of participation
required of HPD personnel. The HPD may participate in
Nuclear Explosive Safety reviews, assembly/disassembly
reviews, nuclear explosive offsite transportation
review, and related risk assessment studies (health
efforts) to provide health protection technical input.
(12) Director, Environmental Protection Division is responsible to
the Assistant Manager, OESH, and assists the Manager, AL, in
assessing the environmental compliance, including National
Environmental Policy Act requirements of facilities and
programs supporting the Nuclear Explosive and Nuclear Weapon
Operations.
(13) Director, Safety Programs Division (SPD)
(a) Safety Analysis and Review System. Supports NESD in the
review and assessment of safety analysis documentation
for weapons systems assembly, disassembly, storage, and
transportation systems.
(b) Functional Reviews and Appraisals. The SPD routinely
performs functional reviews and appraisals for nuclear
safety, facilities design, risk management, and
operational safety programs of Albuquerque contractor
sites to include aspects of the weapons programs. These
appraisals assess the overall program and specific
compliance with the applicable DOE Orders, in the
following types of Nuclear Weapons Safety reviews and
appraisals: offsite transportation of nuclear
components and weapons assembly/disassembly programs.
(14) Director, Operations Quality Division is responsible to the
Assistant Manager, OESH, for assisting the Manager, AL, in
the quality assurance responsibilities regarding nuclear
facilities and/or programs involved in nuclear explosives
safety and handling of nuclear materials.
(a) Supporting NESD in quality assurance aspects, of those
processes related to:
1) offsite packaging and transportation,
2) packaging certifications, and
3) packaging program QA appraisals.
(b) Exercising quality assurance oversight responsibility as
delegated by the Weapons Quality Division for the above,
as well as processes related to nuclear explosives and
weapons safety activities.
(15) Director, Nuclear Explosive Safety Division (NESD) is
responsible to the Assistant Manager, OESH, for:
(a) Carrying out the authorities of the Manager, AL,
contained in DOE Order 5610.10, paragraphs 10.g.(4) and
10.h.(2).
(b) Carrying out the authorities of the Manager, AL, to
provide independent evaluation and oversight
responsibilities of this Supplemental Directive.
(c) Carrying out the authorities of the OESH, to provide
monthly activity reports to HQ, DOE, DP-20, on progress
and activities related to this Supplemental Directive.
(d) Assuring that a corrective action program to document
and track the implementation of actions is maintained
for DOE Order 5610.10.
(e) Assuring that appropriate safety awareness and training
programs are developed, documented, and implemented to
ensure the safe conduct of activities covered by DOE
Order 5610.10.
