CONFERENCE ON MEASURES TO FACILITATE THE TAKE EFFECT OF THE TREATY OF COMPLETE PROHIBITION OF THE NUCLEAR TESTS

Sir President:
 

First Permítame in sugar to express the congratulations of my Delegation by his deserved selection to direct the works of this conference, I am sure that its personal knowledge and abilities, they guarantee that the aims and the intentions to us of if same will be boarded effectively with the intention of achieveing the success of this meeting. Nicaragua this deciding to lend its total collaboration in these efforts.

The States possessors of nuclear weapons have a very significant responsibility, these arms in if same constitute a constant danger by the possibility that an explosion or by human will or accident can occur. In anyone of the two cases the damages can be disastrous; the damage in the affected populations and territories would be incommensurable. Let us think that the best prevention to avoid these consequences is the total elimination of the nuclear weapons.

Nicaragua loving country of La Paz and firmly jeopardizes in the maintenance of the Security the International, has promoted in this Forum of the United Nations and in other international forums the nuclear disarmament. The Nicaraguan position as nonnuclear country is a principle position and has demonstrated with facts when ratifying diverse general Multilateral Treaties to it of prohibition of the use of nuclear weapons including the Tratádo de Complete Prohibición of the Nuclear Tests and the Treaty for the Proscripción of the Nuclear weapons in fa Latin America and the Caribbean. (Treaty of Tlatelolco).

Although technologically my country cannot produce this type of arms, it has been commited not to allow nor to authorize to no other State that can produced to that it sells to us, donates, uses, transport nuclear weapons, and to prevent any nuclear explosion in Nicaraguan territory,

Nicaragua considers that the consultative opinion of the Court the International of Justice on the Legality of the threat or the use of the nuclear weapons, emitted the 8 of 1996 July continues being of great importance in the matter of nuclear disarmament, in her settles down with clarity that the States that they have nuclear weapons have the legal obligation to undertake of good faith negotiations directed to the nuclear disarmament in all their aspects and to conclude them as soon as possible.

Sir President:

In order to progress towards a free world totally of nuclear weapons, it is necessary that they are continued negotiations to be fortifying the series of International Instruments and other initiatives that have been processed by the Community the International which they constitute a regime of not-proliferation and nuclear disarmament, in which they must participate and contribute all and each one of the States that comprise of the same one. In that sense the company/signature, ratification and take effect of the Treaty of Complete Prohibition of the Nuclear Tests will play a transcendental role, its fulfillment is considered of vital importance for the maintenance of the world-wide security and the unequivocal way to obtain the complete elimination of the nuclear arsenals under strict and effective intemacional control.

The Treaty of Complete Prohibition of Ensayos Nucleares (TPCE) that outside approved by the General Assembly the 10 of September of 1996, was the culmination of one of the negotiations longest in the history of the control of armaments in that important commitments and measures in the sphere of the nuclear disarmament and the not-proliferation were gotten up, between which they emphasize the reestablishment of the balance in the reciprocal relations in the Treaty of nonProliferation and the facilitación of a new understanding between the States possessors and nonpossessors of nuclear weapons in addition of which, the cessation of tests will restrict the development and the improvement of new types of nuclear weapons, at the same time the States that do not have such arms to develop them.

At the present time it is reaching the universal treaty character, with 161 signatories, 85 of them to have ratified, including my country that deposited the corresponding instrument in the Secretary of the Nations United in December of 2000; nevertheless, for its take effect the ratification is still needed 13 of the States whose ratification is necessary, including 2 States that have nuclear weapons.

We insist on which the profit of the universal adhesion is the goal of this Conference, however, while is slope of the take effect of the Treaty of Complete Prohibition of the Nuclear Tests, we exhorted to the States that maintain a moratorium of the accomplishment of the nuclear tests to continue maintaining it, but must remember that this unilateral measurement of the States at issue, at no moment it can be considered like a substitution to obligacíón that it involves the signing and rafficación of this Treaty.

We considered that the Preparatory Commission of the Organization of the Treaty has come carrying out a work praiseworthy, specially in its efforts to guarantee that at the moment of the take effect of the Treaty, the verification regime can to fulfill the requirements established in accordance with article IV of the Treaty. As Been part in the Treaty we continue supporting the workings of this regime.
 

Sir President:

The total success of the fulfillment of the Treaty depends on the effectiveness of the universal verification of the System, from which each State starts off must make sure the application of its norms in its territory, and of which all the States adhere to the Treaty and fulfill their dispositions. Reason why we exhorted to those States that have signed the Treaty but that, not yet they have ratified it, in individual those whose ratification is necessary for its take effect, to that they accelerate the process of rafflcación with the intention of becoming State starts off.

In the same way, we make a call to all the States that have not signed the Treaty, to that to sign and to ratifies to the possible brevity, and meanwhile they abstain to make opposite actions to the object and purpose of the Treaty.

Of equal way to all the States, that form the Community the International, not concerning its status in relation to the Treaty, while this it has not taken effect, to continue respecting its sustantivas dispositions; the whole humanity greatly will be thanked for them, since its future could depend on that attitude.

Without a decided performance to make of the Treaty a reality, we will inherit a future for our children who do not deserve, We must take that firm step to ratify the Treaty, to recognize our responsibility before a great majority of the humanity that this totally defenseless against the multiple effects of the explosions of the nuclear weapons.

Sir President:

There is no alternative, we do not have another way and some is no excuse to delay the entrance in use of the Treaty of Complete Prohibition of the Nuclear Tests. To live peacefully with equality and surely, is a fundamental right, where each dawn allows to renew the confidence in our humanity so that they always have the wisdom to take the decisions and measures necessary to guarantee a better future and to recognize than we are only the able ones to turn the dreams in fact.
