Decision of the Joint Consultative Group on Additional
Procedure for Reduction by Destruction of Armored Combat Vehicles Limited
by the Treaty on Conventional Armed Force in Europe and the Implementation
of this Procedure
29 June 1993
- Pursuant to Section I paragraph 5 of the Protocol on Procedures
Governing the Reduction of Conventional Armed Forces in Europe of
19 November 1990, hereafter referred to as the Protocol on Reduction,
the Joint ConsultativeGroup decided on 29 June 1993 that the
additional procedure for reduction of armored combat vehicles by destruction,
as Specified in paragraphs 2 to 6 of this decision, shall be deemed
sufficient to carry out the reduction of conventional armaments and
equipment limited by the treaty.
Procedure for destruction by deformation and severing:
- the armored combat vehicle, including the hull, turret and integral
main armament, if any shall be placed in a large capacity cutting
machine, and
- it shall be deformed and severed so that none of its parts measure
more than 500 millimeters in width, 500 millimeters in height,
and 1000 millimeters in length.
- A State Party intending to implement the additional procedure specified
in Joint Consultative Group 1 of this decision shall identify, in
the "Remarks" section of its calendar reporting period notification
provided pursuant to Section X, paragraph 5 of the Protocol on Reduction,
the Specific during which this additional procedure will be used.
In the event that a State Party calendar reporting period notification
included other procedures as well as this additional procedure, this
additional procedure shall be used at the beginning and/or at the
end of the calendar reporting period.
- The inspection team shall have the right to observe implementation
of the additional procedure Specified in paragraph 1 of this decision
on a continuous basis whenever this additional procedure is used.
- The States Parties, in approving the additional procedure Specified
in Joint Consultative Group 1 of this decision, waive their right
set forth in Section X, paragraph 7 of the Protocol on Reduction,
to record, subsequent to the reduction, factory serial numbers from
the armored combat vehicles which have been reduced by this additional
procedure.
- Notwithstanding the decision of the Joint Consultative Group on
18 December 1991, on " Distribution of costs of inspections between
or among States Parties, worked out in compliance with article XVI,
paragraph 2 (F) of the Treaty on Conventional Armed Forces in Europe
of 19 November 1990", an inspected party which uses the additional
procedure Specified in Joint Consultative Group 1 of this decision
shall receive no payment for costs incurred for inspection of such
a reduction. Specifically, days during which this additional procedure
is used shall not be included in calculating the number of inspector
days during a reduction phase in which inspection teams were present
at reduction sites on the territory of the inspected party conducting
inspections pursuant to Section X paragraphs 1 to 10 of the Protocol
on Reduction.
- This decision does not prejudice any party's right to apply the
reduction procedures as set forth in the Protocol on Reduction or
to apply the additional procedures for reduction set forth in the
decision of the Joint Consultative Group of 11 May 1993. This decision
also does not prejudice the rights of any States Parties with respect
to inspection of reduction by any procedure other than that Specified
in paragraph 1 of this decision.
